Please read these terms and conditions carefully before using the www.SmartScoops.com website and pet waste removal services operated by Smart Scoops (“us”, “we”, or “our”).
Terms and Conditions of Service
Smart Scoops and its employees guarantee the quality, reliability, and professionalism of our services. By accessing and using the Smart Scoops service, you, as the client, are acknowledging and agreeing to be bound by the terms and provisions of this agreement. Additionally, when utilizing any of our services, you are subject to any applicable posted guidelines or rules. The use of this service signifies your acceptance of this agreement. If you do not agree to comply with the outlined guidelines, please refrain from using this service. All items listed below are contingent on territory and are subject to change at any time.
Consent to Contact
Cell Phone Calls/Text and Emails. By providing your cell phone number and/or email address, you consent to receiving such calls or electronic communications at the number or email address provided, including but not limited to, communication attempts (calls, text messages, emails or other electronic means) made by automated telephone dialing system, pre recorded messages or artificial voice. This consent is for Service Provider and any affiliates, including any and all third-party entities hired by Service Provider for billing, collections, or client care services.
Access to Property
By utilizing Smart Scoops services, you authorize our team of professionals to access designated yard or kennel areas of your property on the specified service date. If, for any reason, our technician is unable to enter your property, we will make a note of the occurrence and you may be charged the full price of the service. Please note that our technicians are not allowed or required to enter a client’s home under any circumstances. This rule does not extend to screened patios or pool areas attached to the exterior of the home.
Gated Communities
Smart Scoops requires homeowners in gated communities to provide gate codes and/or guard gate authorization for expedited access. In the event that we cannot access your gated community, we will reach out promptly to you via phone, text and email to gain access to the gated community or area. If we are unable to reach you, service will be skipped and you will be charged for the visit.
Gate Locks
For gated/fenced properties requiring access, Smart Scoops offers a complimentary durable and weatherproof combination lock for the duration of your subscription. In the event that our lock is missing from the gate/fence during your subscription a new lock will be placed, and a lock fee will be assessed to your account for the amount of $15.00. In the event of subscription cancellation, you hereby authorize Smart Scoops to retrieve the provided lock from the property by subscribing to our service. If at the end of the subscription period the lock is found missing when we come to retrieve it, a lock fee will be assessed to your credit card for the amount of $15.00.
Payment
At Smart Scoops, we are committed to providing our clients with convenient and affordable pet waste removal services. Residential clients are responsible and required to provide card information before services are rendered.
We currently accept credit and debit cards as forms of payment for our subscription service. Your card will be securely stored and charged on a recurring basis unless you choose to cancel or make changes to your subscription. If a client’s payment method is declined, service will be discontinued immediately until the issue has been resolved. If more than 30 days have passed since the last clean up, a first time cleaning fee will be applied when service is resumed.
Subscription Changes
You have the option to upgrade, downgrade, add to or cancel your subscription at any time before the monthly billing date. If you choose to upgrade or downgrade, the changes will take effect on the next billing cycle. If you cancel your subscription, it will be effective immediately and no further charges will be made.
Price Changes
We may occasionally change the price of our subscription service. However, any changes to the price will not affect current subscribers until their next billing cycle. We will notify all subscribers of any price changes at least 30 days in advance.
Refunds
If you choose to cancel your subscription, the cancellation will be effective immediately and you will not be charged for any future billing cycles.
Service Options
Service options are solely based on territory and services assigned by respective locations at a given time. Service schedule availability can change based on business needs and general workday productivity. You, the client, are responsible for notifying Smart Scoops of any changes in subscription or additions. Client is also responsible for notifying Smart Scoops of service cancellation and is required to do so 24 hours before service.
Service Times/Service Days
Smart Scoops is unable to offer time-specific visits due to various variables. Scooping and service hours are from sunrise to sunset. The Service Provider operates in various weather conditions, rain or shine. In the event of unsafe weather or road conditions, Services may be paused or skipped, and affected clients will be promptly notified. Occasionally, at the Service Provider’s discretion, rescheduling or changes to the Service day(s) may be necessary. Service days are determined by the client’s address and established routes, helping to maintain competitive pricing. The client’s monthly fee covers specific holidays observed by the Service Provider without additional cost or service compensation. These holidays include New Year’s Day, Memorial Day, Independence Day, Thanksgiving Day, Christmas Eve and Christmas Day. During service interruptions caused by factors beyond the Service Provider’s control, such as snow, heavy rain, strong winds, hurricanes, extreme temperatures, acts of governmental authorities, acts of God, or other circumstances, the client may be charged, but they have the option to cancel or pause services during this time. Applicable service charges may apply upon resumption of service.
Referral
Smart Scoops is committed to maintaining its referral policy. When you refer someone with our TAG card and that person purchases a subscription service with Smart Scoops, both the referrer and referral will receive a complimentary yard sanitation and deodorization, given that both parties are active subscribers to Smart Scoops. Please be aware that this introductory free service is available only in select areas that we service.
Locked Property
If the Smart Scoops technician is unable to access the designated yard space due to a locked gate with an unknown lock, and cannot otherwise access a client’s property, we will reach out promptly to you via knocking on the front door, ringing the doorbell, text, phone and email to gain access to the property or area. If we are unable to reach you, service will be skipped and you will be charged for the visit.
Inclement weather
In the event of adverse or severe weather conditions, Smart Scoops reserves the right to exercise caution by either postponing or skipping services. Timely notifications via door, text and phone call will be sent to clients, and necessary adjustments will be made accordingly. Please note that we do not offer refunds for missed weeks due to weather. Alternatively, our technicians will pick up all of the waste that would have been removed during the prior week. If you require immediate cleaning before your next scheduled visit, please contact us, and we will make every effort to accommodate your request.
Animal Presence
Although our technicians appreciate your pets, we require that no pets be in the yard during our scooping process. In the event that our assigned Smart Scoops technician encounters an animal in the designated yard area, we will promptly leave the premises and contact you via door knocking, door bell, text, and phone call. If the technician is unable to reach you, the service scheduled for the selected day will be skipped.
Overgrown Grass, Leaves and Debris
We strive to provide the utmost care in keeping your yard clean. We understand that maintaining a pristine yard can be a demanding task, and it may not always be in optimal condition. We acknowledge that locating pet waste can be challenging amidst tall grass, leaves and/or debris. If any waste is missed during our visit due to tall grass, leaves and/or debris, rest assured that we will address it promptly on our next scheduled maintenance visit. In cases where we are unable to provide service due to overgrown grass, leaves, or excessive debris, our technician will notify you promptly via text and a physical card left on your door.
Missed Piles
If any piles are overlooked during the scheduled service, it is the client’s responsibility to promptly notify Smart Scoops within 12 hours of scheduled service with a picture of the pile. In cases where the grass is not overgrown, and there are no excessive leaves or debris, a complementary rescoop will be conducted on Fridays. This will ensure an uninterrupted weekend without any missed piles.
Scoop & Haul
As part of the Smart Scoops Scoop & Haul services, our team will perform a thorough assessment of your property to effectively remove pet waste. We will efficiently transport the waste to designated facilities, ensuring it does not go into your trash bins. Our Scoop & Haul pricing is valid for properties with up to 5 dogs, if a property has more than 5 dogs an additional fee will be applied. If the Smart Scoops team discovers that there are more than 5 dogs on the property, additional fees will apply.
Yard sanitization
The Smart Scoops team utilizes our state-of-the-art Smart Sprayer™ technology to apply a sanitizing solution. This solution deeply permeates your yard, effectively neutralizing odor-causing bacteria and eradicating a wide range of viruses, bacteria, and fungi, including influenza and canine parvovirus. Thorough sanitation targets over 50 different viruses. Pets and animals are safe to access the property after the sanitizing solution has thoroughly dried. Smart Scoops cannot be held responsible for the contraction or presence of viruses, bacteria, or fungi in pets or on properties.
Yard deodorization
The Smart Scoops team utilizes our state-of-the-art Smart Sprayer™ technology to apply a deodorization solution that targets and neutralizes odor-causing bacteria. Smart Scoops uses a fresh lemon scent in the deodorization process.
Grass repair
Pet urine contains high levels of nitrogen, which can be detrimental to grass, resulting in yellowing or burnt patches. Smart Scoops’ grass repair service offers an effective solution by utilizing an eco-friendly tinting agent to camouflage the discolored areas and prevent unsightly spots. This long-lasting grass repair treatment is designed to last up to 12 weeks and make grass appear vibrant and green. The grass repair does not contain any fertilizers.
Dog repellent
Smart Scoops Dog Repellent service is specifically designed to discourage animals from using or defecating on the clients’ property. Our effective dog repellent solution is carefully applied to a two-foot interior area of pedestrian sidewalks or roadways. Please note that it may take some time for the repellent to completely deter animals from the treated areas, as they may attempt to return. However, with consistent use of our product, animals will learn to avoid these treated areas over time. Smart Scoops cannot be held liable for any animals that still utilize or defecate in areas where our dog repellent has been applied.
Commercial Dog Runs
Commercial dog runs are fenced in areas specifically in commercial and community areas for visitors to provide a space for their pets to relieve themselves, exercise and play. Smart Scoops offers scoop and haul services for commercial dog runs. Our team will examine the property including grass and mulch beds, scoop any piles, haul and dispose of any dog waste.
Waste Station
Smart Scoops provides waste station maintenance on a weekly basis for commercial subscription clients, this service includes refilling up to 1200 bags per station, removal and hauling of receptacle trash and debris. Scoop and Haul services for 20 feet around the waste station can be added for an additional fee.
Installation and Removal of Waste Stations
Scoops provides professional installation of new waste stations with a comprehensive warranty on hardware, metal components, and signage for the duration of the subscription. Our expertise extends to custom-designed signage for multi-family and HOA communities, commercial properties, parks and recreation areas, public works, and more. Our team handles communication with utility companies to ensure the identification and marking of existing utility lines before installation. If a utility line obstructs the agreed-upon placement, we will select the nearest suitable area. Please note that Smart Scoops does not offer a warranty or assume liability for existing waste stations not installed by our company. Additionally, we offer removal and haul away services for pre-existing pet waste stations at an additional fee. In cases where a concrete base is present, our team will excavate and remove it for an extra charge laid out in contract.
DNA Sampling
Smart Scoops offers professional DNA Sampling services for commercial properties. Our service includes the collection of stool samples from designated areas, ensuring they are carefully secured in sterile containers. We then place the sample-filled containers in specimen bags for delivery to the client. Please note that Smart Scoops is not responsible and will not be held liable for conducting the testing or providing the results of the samples.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
Terms and Conditions of Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least a day’s notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Terms and Conditions of Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of Smart Scoops and its licensors.
